Abstract
Immigration is a human rights issue, however nativist frame immigration as a law enforcement issue. The objective of this study is to situate the debate as a human rights issue and pose a challenge to the nativist frame of immigration. The study will start by analyzing the general history of immigration and then exposing the discrimination that has targeted Latinx people. The study will then evaluate the systemic discrimination that is exemplified through the Doctrine of Plenary Powers.Using Kant’s moral theory and Rawl’s theory of Justice I will be supportingthe arguementthatwe are morally obligated to grantimmigrants, form Latin America, equal basic human rights
